Terms of Service

These Terms of Service (the "Terms") are the agreement between you and RunBoost B.V. ("RunBoost", "we", "us") that governs your use of the RunBoost mobile app, website, APIs and related services (together, the "Service"). Please read them carefully. By creating an account or using the Service you agree to be bound by them.

1. Important health disclaimer: read first

RunBoost is a training and coaching tool. It is not a medical device, it does not provide medical advice, diagnosis or treatment, and it is not a substitute for consultation with a qualified health professional, physiotherapist, or sports physician.

  • Consult a doctor before starting, significantly increasing, or resuming any training programme, especially if you are pregnant, recovering from surgery or injury, managing a chronic condition, or over the age of 45 and new to running.
  • Stop exercising immediately and seek medical attention if you experience chest pain, dizziness, shortness of breath beyond normal exertion, fainting, or any symptom that concerns you.
  • The AI coach's suggestions are generated from data you provide. They can be wrong, incomplete, or outdated. Use your own judgement and listen to your body.
  • You exercise at your own risk. To the maximum extent permitted by law, you accept all risk of injury, illness, or harm arising from your use of training plans or suggestions produced by the Service.

2. Who may use RunBoost

  • You must be at least 16 years old. If you are between 16 and 18, you confirm that your parent or guardian has reviewed and accepted these Terms on your behalf.
  • You must have the legal capacity to enter into a binding agreement in your jurisdiction.
  • You must not be barred from using the Service under applicable laws or sanctions.

3. Your account

  • You are responsible for the accuracy of the information you provide.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • You must notify us promptly at support@runboost-app.com if you suspect any unauthorised use of your account.
  • We may suspend or terminate accounts that violate these Terms, abuse the Service, or pose a security or legal risk.

4. The Service

RunBoost provides AI-generated training plans, activity analysis, adaptive load management, injury-recovery guidance, and a conversational AI coach. We may add, change, or remove features; we may also impose usage limits to keep the Service stable for everyone.

5. Subscriptions, trials, and payments

  • Some parts of the Service are free; others require a paid subscription. The applicable price, billing period, and renewal terms are shown at checkout.
  • Subscriptions auto-renew at the end of each billing period until cancelled. You can cancel any time via the app store where you subscribed, or in your account settings.
  • Free trials convert to paid subscriptions unless cancelled before the trial ends.
  • Taxes (such as VAT) may apply in addition to the listed price.
  • Refunds are handled according to the policy of the store you subscribed through (Apple App Store, Google Play, Stripe, etc.). EU/UK consumers may have additional statutory rights, including a 14-day right of withdrawal which you waive by starting to use paid features immediately, as permitted under Art. 16(m) of the EU Consumer Rights Directive.

6. Connected services (Apple Health, Garmin, etc.) and Strava

You may choose to connect RunBoost to third-party services. By doing so, you authorise us to access, receive and send data in the scopes you approve. Your use of those services is governed by their own terms and privacy policies. We are not responsible for outages, bugs, policy changes, or data issues originating from those platforms. You can disconnect at any time.

6.1 Strava integration

Our use of the Strava API is governed by the Strava API Agreement, the Strava Terms of Service, and the Strava Privacy Policy. If you connect Strava to RunBoost, you also agree to Strava's terms as they apply to you as an end user.

When you use the Strava integration, you acknowledge and agree that:

  • RunBoost will only access your Strava data within the scopes you authorise, and only to provide the RunBoost Service to you.
  • RunBoost will not display to you the Strava data of any other Strava user, even where such data is publicly visible on Strava.
  • RunBoost will not sell, licence, share, or otherwise make your Strava data available to any third party, and will not use it for advertising.
  • RunBoost will not use Strava data (directly or indirectly, and whether identifiable, de-identified, or aggregated) to train or evaluate any AI, machine-learning, or similar model.
  • RunBoost will not combine Strava data with data from other sources, and will not use Strava data for analytics, benchmarking, customer insights, or product improvement.
  • If you delete an activity on Strava, change a privacy setting, or disconnect RunBoost from Strava, RunBoost will reflect that change promptly, and in any event within 48 hours.
  • Strava makes no warranties in connection with the Strava API or Strava data, and is not liable to you in connection with RunBoost's use of the Strava API. Strava expressly disclaims all implied warranties (including of merchantability, fitness for a particular purpose, and non-infringement), and is excluded from all liability for indirect, special, consequential, and punitive damages in connection with the Strava integration.
  • Strava may at any time modify, suspend, or discontinue the Strava API, and may revoke RunBoost's access; in those cases the Strava integration (but not the rest of RunBoost) may stop working.

The Strava and Garmin names and logos are trademarks of their respective owners and are used solely for the purpose of indicating data origin in accordance with those owners' brand guidelines.

7. AI-generated content

The AI coach produces responses based on the data you provide. AI output can be inaccurate, biased, inconsistent, or out of date. You should:

  • Treat AI output as a suggestion, not a prescription.
  • Not rely on it for medical, legal, financial, or other professional advice.
  • Never submit information about other people without their permission.

Subject to your rights under applicable law, the output generated for you in your account is yours to use for personal, non-commercial purposes.

7.1 No AI model training on user data, ever

RunBoost does nottrain, fine-tune, evaluate, or otherwise use any personal data, any training data, any health-related data, any conversation with the AI coach, any Strava-sourced data, or any other data associated with you, to develop artificial-intelligence, machine-learning, or similar models, whether our own or a third party's, whether identifiable, pseudonymised, de-identified, or aggregated.

There is no opt-in to allow this, and we will not introduce one. Our AI providers are contractually prohibited from training on, fine-tuning on, or retaining your inputs or outputs beyond the minimum window necessary to return the response and detect abuse. If this commitment ever changes materially, it will only be through a separate product that you separately sign up for. See Section 8 of the Privacy Policy.

8. Acceptable use

You agree not to:

  • Use the Service in a way that violates applicable law or infringes anyone's rights.
  • Upload malicious code or attempt to interfere with, disrupt, or gain unauthorised access to the Service or its infrastructure.
  • Scrape, crawl, or reverse-engineer the Service, except to the extent permitted by mandatory law.
  • Resell, sublicense, or commercially exploit the Service or its content without our prior written consent.
  • Impersonate another person, submit fraudulent data, or create accounts in bulk.
  • Use the Service to build a competing product, or to train machine-learning models that replicate it.

9. User content

You retain ownership of the content you submit: your runs, notes, messages, and feedback ("User Content"). You grant RunBoost a worldwide, non-exclusive, royalty-free licence to host, store, process, and display your User Content solely in order to operate the Service for you. RunBoost will not use your User Content to train AI or ML models, and will not use Strava-sourced User Content for analytics, aggregation, benchmarking, customer-insight, or product-improvement purposes (see Sections 6.1 and 7.1, and the Privacy Policy).

10. Intellectual property

RunBoost, its logos, software, designs, and training-plan templates are owned by RunBoost or its licensors and are protected by copyright, trademark, and other laws. These Terms do not grant you any rights in our intellectual property other than the limited licence to use the Service.

11. Beta and experimental features

We may offer features labelled as "beta", "preview", or "experimental". These are provided as-is, may be unstable, and may be changed or removed at any time.

12. Termination

You can stop using the Service and delete your account at any time from the app settings or by emailing support@runboost-app.com. We may suspend or terminate your access if you materially breach these Terms, if we are required to by law, or if continuing to provide the Service to you would pose a security, legal, or safety risk. Where reasonable, we will give you notice. Sections that by their nature should survive termination (e.g. liability, indemnity, governing law) will survive.

13. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, error-free, or that AI output will be accurate.

Nothing in these Terms limits consumer rights that cannot be excluded under applicable law. If you are a consumer in the EU, UK, or another jurisdiction with mandatory consumer-protection rules, those rules continue to apply to you.

14. Limitation of liability

To the maximum extent permitted by law:

  • RunBoost is not liable for indirect, incidental, consequential, special, or punitive damages, or for loss of profits, data, goodwill, or opportunities.
  • Our total aggregate liability arising out of or relating to the Service in any 12-month period is limited to the greater of (a) the amount you paid us for the Service in that period, and (b) EUR 100.
  • Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by our negligence, fraud, or intentional misconduct.

15. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless RunBoost, its officers, employees, and partners, from claims, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your violation of a third party's rights.

16. Changes to the Service or the Terms

We may update these Terms to reflect changes in the Service, in our business, or in the law. If changes are material, we will notify you in-app or by email at least 14 days before they take effect. If you do not agree, you may stop using the Service and delete your account before the changes take effect.

17. Governing law and jurisdiction

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules. Disputes will be submitted to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands, except that consumers may also bring proceedings in the courts of their country of residence, as required by EU law.

18. Miscellaneous

  • If a provision is found unenforceable, the rest of the Terms remain in effect.
  • Our failure to enforce a right is not a waiver of that right.
  • You may not assign these Terms without our written consent; we may assign them to an affiliate or successor.
  • These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service.
